Presented by Jeff Follett and Brian Henninger of Foley Hoag LLP, Jim Evans of Albert Risk Management, and Kurt Dettman of Constructive Dispute Resolutions

 

After developing a track record on the West Coast, "Integrated Project Delivery" is finally making inroads into New England. The concept is simple enough: use a single contract among the owner, architect and contractor to form a team in which everyone has an incentive to collaborate and the project's overall success impacts everyone's bottom line. But turning that concept into reality involves addressing a number of real world challenges, including how to structure commercial terms and how to find insurance coverage that fits a collaborative project approach.

 

Jeff and Brian will begin this two-part workshop with a focus on contracting issues. How does negotiating the terms of an IPD project differ from negotiating any other deal? What are the differences among the various competing IPD contract forms, and do those differences really matter? And if your team members aren't ready to take the full IPD plunge, are there still ways to test the waters on a more traditionally-structured project by adopting some of the incentives and procedures of IPD contracts?


Jim and Kurt will then explain the unique insurance issues posed by IPD projects and how the insurance industry is working to address those issues. Under current IPD contractual arrangements, there often is an exception from “no blame” decisions and liability caps when there are claims covered by insurance. This creates a tension between the underlying collaborative principles of IPD and the fault based principles of traditional insurance products. Jim will cover how IPD projects are being insured now, the issues that traditional insurance products creates when superimposed over IPD contractual relationships, and changes that could be made to current insurance products that can make them more effective for IPD projects.

LCI New England CoP



The Lean Construction Institute (LCI), a non-profit research organization, was founded in August 1997. LCI's purpose is to develop and disseminate new knowledge regarding the management of work in design, engineering and construction for capital facilities. LCI has developed the Lean Project Delivery System© (LPDS), and the Last Planner® System of production control. Lean Construction is a production management-based approach to project delivery - a new way to design and build capital facilities. Lean production management has caused a revolution in manufacturing design, supply and assembly. Applied to construction, Lean changes the way work is done throughout the delivery process. Lean Construction extends from the objectives of a lean production system - maximize value and minimize waste - to specific techniques and applies them in a new project delivery process extending from project definition through design, supply and assembly.

The New England Community of Practice of LCI  provides local lean support to owners, architects and designers, engineers, contractors, specialty contractors, and suppliers.  We invite owners and project delivery team members to meet together as a local user group to learn, share, and develop a lean community in New England. As a regional forum for conversations among practitioners, the CoP will help create a new common sense for the AEC industry as LCI continues to build knowledge in design and construction.
